Terms of Service
Draft - pending legal review. This document has not yet been reviewed by a lawyer and may change before it takes effect.
These Terms of Service ("Terms") govern your use of Jantaris Studio, the Jantaris API and the website at jantaris.com (together, the "Service"). By creating an account or using the Service you accept these Terms. If you use the Polish version at jantaris.com/pl (also reachable at jantaris.pl), the Polish Terms (Regulamin) apply instead.
1. Who we are
The Service is provided by Piotr Olszewski, ul. Białołęcka 247, 03-253, Warszawa, tax ID (NIP) 5242572263 ("Jantaris", "we", "us"). You can contact us at promptowy@gmail.com. This address is also our single point of contact for users and authorities under the EU Digital Services Act. We communicate in English and Polish.
2. Definitions
- Account - your user account in the Service.
- Balance - prepaid funds on your Account, expressed in US dollars, used to pay for Generations.
- Top-up - a payment that adds funds to your Balance.
- Generation or Task - a single request to an AI model made through Studio or the API, for example an image, a video clip, an audio track or a chat completion.
- Input - anything you submit to the Service: prompts, parameters, images, audio, files and URLs.
- Output - the result a model returns for your Input.
- API Key - a secret key (starting with
sk-jt-) that authenticates API requests on your Account. - Consumer - a natural person using the Service for purposes outside their trade, business or profession.
3. The Service
3.1. The Service gives you access, through one Account and one Balance, to AI models developed by third parties for generating images, video, audio and music, and for chat and code. Models run on infrastructure operated by third-party providers. The Service uses third-party AI model infrastructure providers, including reAPI (reapi.ai), through which generation requests are passed to model vendors.
3.2. The list of models, their parameters and prices is published at /models and through GET /v1/models. We may add, change or remove models, for example when a developer retires a model or changes its terms. We will try to give reasonable notice before removing a model that is in active use, but we cannot guarantee that any particular model will remain available.
3.3. Model output is generated automatically and may be inaccurate, incomplete, unexpected or similar to output produced for other users. You should review Output before relying on it or publishing it.
3.4. We do not promise any specific availability level, response time or support hours. For some models we route requests to more than one infrastructure provider to reduce the impact of outages, but this does not guarantee uninterrupted service.
3.5. To use the Service you need a current web browser with JavaScript enabled (for Studio) or an HTTP client able to send HTTPS requests (for the API), and an email address.
4. Your Account
4.1. You must be at least 18 years old and able to enter into a binding contract. If you create an Account on behalf of a company or other organization, you confirm that you are authorized to bind it to these Terms.
4.2. Provide accurate information and keep it up to date, especially billing details. You are responsible for keeping your login credentials confidential and for all activity on your Account.
4.3. One person or organization may hold more than one Account only for legitimate reasons, such as separating projects. Creating Accounts to abuse the referral program, avoid a suspension or get around rate limits is prohibited.
4.4. You may not use the Service if you are subject to sanctions that prohibit us from providing it to you, or from a country where providing the Service would violate applicable export control or sanctions law.
5. Balance, prices and payments
5.1. The Service works on a prepaid basis. There is no subscription and no minimum commitment. Accounts on jantaris.com are billed in US dollars.
5.2. The minimum Top-up is $10. We offer packages of $10, $25, $50, $100 and $250. The amount added to your Balance equals the amount you pay.
5.3. Prices shown on jantaris.com are in US dollars and exclude taxes. The amount you pay equals the amount added to your Balance. Customers who need a Polish VAT invoice, or reverse charge as an EU business with a valid VAT number, can use the Polish version of the Service at jantaris.com/pl, which bills in Polish zloty.
5.4. Payments are processed by our payment provider, Stripe. We do not receive or store your full card number. Funds are added to your Balance after the payment provider confirms the payment. An invoice or receipt is issued for every Top-up and made available in your Account.
5.5. Your Balance does not expire and we do not charge inactivity fees.
5.6. Each model has a published unit price: per image, per second of video, per track or second of audio, or per million input and output tokens. Before a Generation starts, the Service shows its estimated cost (estimated_cost in the API). When you start a Generation, that amount is held on your Balance. When the Generation completes, the actual cost is charged and any unused part of the hold is released. For chat models, the cost is based on the tokens actually processed.
5.7. If a Generation ends with status failed, including because of a provider error, a timeout or a model refusing the Input, you are not charged and the hold is released in full. A Generation that completes successfully is charged even if you are not satisfied with the Output.
5.8. If your Balance does not cover the estimated cost of a Generation, the request is rejected (HTTP 402) before it starts.
5.9. We may change model prices, for example when a provider changes its rates or a new model version is released. Price changes do not affect Generations already started. The current price is always shown before you start a Generation.
5.10. If a payment is reversed or charged back, we may deduct the corresponding amount from your Balance and, if the Balance becomes negative, suspend the Account until the amount is settled.
6. Refunds and right of withdrawal
6.1. Our refund rule. Within 14 days of a Top-up you may ask us to refund it by writing to promptowy@gmail.com from the email address linked to your Account. If you have not used the funds from that Top-up, we refund the full amount you paid. If you have used part of them, we refund the unused part. Referral credits are not refunded. We refund to the original payment method within 14 days of receiving your request.
6.2. EU and UK Consumers. If you are a Consumer in the EU or UK, you have a statutory right to withdraw from a distance contract within 14 days without giving a reason. At checkout you ask us to start providing the Service immediately and acknowledge that you lose the right of withdrawal for Generations that have been fully performed. As a result, after withdrawal you pay for the Generations made before you withdrew, and we refund the rest of the amount paid for that Top-up. The refund rule in section 6.1 gives you at least the same result, and you can use either.
6.3. Apart from sections 6.1, 6.2, 14.4 and cases where the law requires a refund, Top-ups are not refundable.
7. API Keys and rate limits
7.1. You can create and revoke API Keys in your Account. Keep API Keys secret: store them on a server, in environment variables or a secrets manager, and never embed them in client-side code, mobile apps or public repositories.
7.2. You are responsible for all usage and charges made with your API Keys until you revoke them. If you suspect a key has leaked, revoke it immediately and tell us. We may revoke a key that we find published publicly or used in a way that suggests it has been compromised.
7.3. By default each API Key may start up to 60 Generations per minute. Requests above a limit receive HTTP 429. We may set other limits to protect the Service, and we may raise limits on request.
7.4. If you use webhooks, verify the x-jantaris-signature header before trusting incoming data. You are responsible for the security of your webhook endpoint.
8. Acceptable use
8.1. You may use the Service only lawfully and in line with these Terms. You must not use the Service to create, upload, store or distribute:
- any content that sexualizes minors or depicts child sexual abuse, in any form, including fictional or drawn depictions; we report such content to the competent authorities;
- intimate, nude or sexual imagery of a real, identifiable person without that person's consent;
- realistic depictions of real, identifiable people (deepfakes) without their consent, or content that falsely presents a real person as saying or doing something;
- content that impersonates a person, company, brand or public authority, or is designed to mislead others about its source;
- content that is otherwise illegal, including content that infringes intellectual property, privacy or personality rights, defames someone, incites violence or terrorism, or harasses or threatens people;
- malware, exploits or tools designed to gain unauthorized access to systems or data;
- spam, phishing, fraud or other deceptive material, including fake reviews and mass unsolicited messages.
8.2. You must also not:
- try to bypass safety filters, content moderation or rate limits, including by splitting or disguising prompts;
- resell raw access to the Service or share API Keys in a way that lets third parties use the Service without an Account, unless we have agreed to it in writing;
- interfere with the Service, probe it for vulnerabilities without our permission, or overload it;
- use Output in breach of the terms of the model that produced it;
- use the Service to make decisions with legal or similarly significant effects on people without human review where the law requires it.
8.3. When you publish realistic AI-generated or AI-manipulated images, video or audio, label them as AI-generated where the law requires it, including under the EU AI Act.
8.4. Individual model developers may apply their own usage policies. A model may refuse a request that complies with these Terms. A refused request is treated as a failed Generation and is not charged.
9. Your Input and Output
9.1. You keep all rights you have in your Input. You confirm that you have the rights and consents needed to submit it, including the consent of any person whose image, voice or personal data it contains.
9.2. You grant us a non-exclusive, worldwide, royalty-free license to host, process, transmit and store your Input and Output only as needed to provide the Service to you, keep your task history, prevent abuse and comply with the law. We do not use your Input or Output to train AI models.
9.3. As far as the law and the terms of the relevant model allow, we claim no rights in your Output. Whether you can use Output, including for commercial purposes, depends on the terms of the model that produced it and on the law where you use it. In many jurisdictions content generated entirely by AI may not be protected by copyright. We do not guarantee that Output is free of third-party rights or that it can be protected.
9.4. You are solely responsible for your Input, for how you use Output and for any content you publish or distribute using the Service.
9.5. Links to Output files are valid for a limited time. Your task history (prompts, parameters, model and cost) is kept for 90 days. We are not a storage service, and you should download Output you want to keep. Details are in our Privacy Policy.
10. Moderation and reporting illegal content
10.1. We use automated filters and, where needed, human review to detect content and activity that breaks these Terms or the law. We may block individual requests, remove Output, revoke API Keys, suspend or close Accounts. Where we restrict your Account or content, we tell you the reason and how to contest the decision, unless the law prevents us or the content is related to child sexual abuse or another serious offence.
10.2. Anyone can report content they believe is illegal by writing to promptowy@gmail.com. Please include the reason, the location of the content (for example a task ID or link) and your contact details. We handle reports promptly and inform the reporting person of our decision.
10.3. You can contest a moderation decision by replying to our notice or writing to promptowy@gmail.com within 6 months. A person, not an automated system, will review your appeal.
11. Referral program
11.1. You can share your referral link (with the ?ref= parameter) from your Account. When a new user signs up through your link within 30 days of clicking it, you receive a commission of 20% of that user's spending on image, video and audio models and 5% of their spending on chat models, for 12 months from their sign-up. Commission is based on the referred user's spending that starts after their first paid Top-up (online payment or a booked bank transfer); credit added by us, such as bonuses, does not earn commission.
11.2. Commission is credited to your Balance. It has no cash value, cannot be withdrawn, refunded or transferred.
11.3. Self-referrals, referrals of your own or duplicate Accounts (including Accounts using another form of the same email address or signed up from the IP address you use), sign-ups made without the referred person's knowledge and misleading promotion are not allowed. We may withhold or reverse commission earned in breach of these rules and close the Accounts involved.
11.4. We may change or end the referral program with 30 days' notice. Commission already credited stays on your Balance.
12. Third-party models and services
AI models available in the Service are developed by third parties and run on third-party infrastructure. We are not responsible for the content of third-party model licenses or policies, but we are responsible towards you for providing the Service under these Terms.
13. Changes to the Service and these Terms
13.1. We may update these Terms for valid reasons, such as changes in the law, new features, changes to models or providers, or security needs. We will notify you by email and in the Service at least 14 days before material changes take effect, unless a shorter period is required by law or by a security threat.
13.2. If you do not agree with the changes, you may close your Account before they take effect. In that case we refund the unused part of your paid Balance (excluding referral credits) on request.
14. Suspension and termination
14.1. You may stop using the Service and delete your Account at any time by sending a deletion request to promptowy@gmail.com from the email address linked to your Account. We delete the Account within 30 days of receiving the request. Before deleting it, use your Balance or request a refund under section 6. Except as provided in these Terms, funds left on a deleted Account cannot be recovered.
14.2. We may suspend or close your Account, with notice and a statement of reasons, if you seriously or repeatedly breach these Terms, if the law requires it, or if your Account is used for fraud or poses a security risk. For less serious breaches we will first ask you to stop.
14.3. If we close your Account because of a breach of section 8, we may keep the unused Balance to the extent needed to cover our losses and claims resulting from the breach, as far as the law allows. Any remaining unused paid Balance is refunded on request.
14.4. If we close your Account or end the Service for reasons not caused by you, we refund the unused part of your paid Balance (excluding referral credits).
15. Disclaimers
The Service and Output are provided "as is" and "as available". To the extent permitted by law, we make no warranties about the accuracy, quality or fitness for a particular purpose of Output. This section does not limit any statutory rights that Consumers have and that cannot be excluded by contract, including the right to a Service that conforms to the contract.
16. Limitation of liability
16.1. Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for intentional harm or gross negligence, for fraud, or any other liability that cannot be limited under applicable law.
16.2. If you use the Service as a business, to the extent permitted by law: (a) we are not liable for indirect or consequential loss, loss of profit, revenue, data or goodwill; and (b) our total liability arising from these Terms in any 12-month period is limited to the amount you paid us in that period.
16.3. If you are a Consumer, we are liable for foreseeable loss caused by our breach of these Terms, in line with the mandatory law that applies to you.
17. Indemnity
If you use the Service as a business, you will indemnify us against third-party claims, fines and reasonable costs arising from your Input, your use of Output or your breach of these Terms.
18. Governing law and disputes
18.1. These Terms are governed by the law of Poland. If you are a Consumer, you also keep the protection of the mandatory rules of the country where you live.
18.2. Disputes with business customers are resolved by the court having jurisdiction over our registered address. Consumers may bring proceedings in the courts of the country where they live.
18.3. If you have a complaint, write to promptowy@gmail.com. We respond within 14 days. Consumers in the EU can also contact their national consumer protection authority or an out-of-court dispute resolution body.
19. Other terms
19.1. If any provision of these Terms is found invalid, the rest remain in force.
19.2. These Terms, our Privacy Policy and the prices shown in the Service form the entire agreement between you and us about the Service.
19.3. We may transfer our rights and obligations under these Terms to another company as part of a reorganization or sale of the business, provided your rights are not reduced. We will notify you in advance.
19.4. These Terms take effect on the day they are published in the Service. The date of the last update is shown at the top of this page.
